Prosecutor Files Criminal Charges for Wilmar Big-Rig Death Crash
March 13th, 2013 by Joe BurgessProsecutor Thomas Deen has filed criminal charges against Bryant Childs, the big-rig driver who jumped out of a loaded asphalt truck, causing he death of the driver of a mini-van, when it was crushed by his abandoned vehicle.
Child’s charges include Manslaughter for the death of Elizabeth Ann Davis, which carries a sentence of 3-10 years in prison, and/or a $10,000 fine.
Childs is also charged with 4 separate counts of aggravated assault, which carry a maximum sentence of 6 years in prison (each) and fines of up to $10,000 (each).
The manslaughter charge includes the words “did recklessly cause the death of Elizabeth Ann Davis.”
The aggravated assault charge includes the words, “under circumstances manifesting extreme indifference to the value of human life, did purposely engage in conduct creating a substantial danger of death or serious physical injury” to each of four other drivers involved in the deadly crash.

Ann was a good woman. She’d worked hard all her life and had reached the age to enjoy retirement. She never was simply sitting there, minding her own business. I don’t know what the driver was thinking, but I know Ann Davis would have ridden that rig over a cliff to try to avoid hurting someone else. She was always looking out for the helpless..I just hate that she didn’t get to enjoy the kind of life she had worked so hard for and which she so richly deserved.
May justice be done for this cowardly act that caused the death of an innocent individual.
Great judgement call. I have heard that this man has jumped more than once from a moving vechile that he was operating. I am so glad that he is going to be held accountable.
May God bless in His way those who chose to act in this way I know it is a responsibility of any driver to prevent an accident of their causing, whatever it takes, even to avoid accidents thats not of their causing. This guy was totally irresponsible. He should be judged by a jury and made to pay the consequences.
