Man Charged with Rape & Kidnapping Accepts 2nd Degree Sex Assault Plea
December 5th, 2012 by Joe BurgessA Wilmar man, formerly of Monticello, accused of kidnapping and raping a woman, accepted a plea to the charge of second degree sexual assault, in Drew County Circuit Court, Monday.
Bobby Theus, age 36, got the maximum charge of a 20 year prison sentence, to the reduced charge.
He described some of the events to the court, explaining that they started from a photo on his cell phone. but admitted to the acts that took place with the victim, last February 25-28.

When it comes to cases like this, I think that the judgement should fit the crime. There should be no “plea” of lesser charges etc. This lady is going to have to live with this the rest of her life!
If he would not have accepted the plea and instead went before a jury he may or may not have received this amount, a less amount or even found not guilty.
The victim will have to live with this the rest of her life and that is so sad and unfair. The good thing about him taking this plea the victim did not have to sit in front of him, the jury or a courtroom full of people and tell step by step what happened.
Go back and review different cases that have gone before juries I think you will look at it differently when you see some that should have got the maximum amount of years got nothing and others that were minimal charges got slammed.
I for one am glad he accepted the maximum sentence for the lesser charge of 20 years. I personally don’t care what “charge” is on his paperwork but do care that he is going to the Department of Corrections for a long time.

Response. th sentence was 20 years. He could be elegible for parole in 1/6 of that time, which would be 3 1/3 years.
his punishment should have been the same thing he did too the lady,even worse. Its the “judges” that are slapping these people on the wrist. And on good behavior, he could be out in less than 2 1/2-3 years. Our justice system is WHACK
