Lawyer Claims DWI Driver Wasn’t Drunk Before Accident (Must’ve Drunk Beer While Waiting for Help)

IMG_6923At around 2 AM, May 6 of last year, a 22-year-old Monticello man was written a DWI and failure to maintain control ticket by Drew county deputy.

Nathan Crouch was in Monticello District Court, recently, represented by his attorney, John Frank Gibson.

In a defense pulled right out of the  mid-’90’s TV series “Picket Fences,” Gibson did not question his client’s .19 BAC score, but instead claimed that he was not intoxicated at the time of the accident, but became intoxicated while waiting for the deputy.

Deputy Bo Sanderlin described the events of that early-morning, including the driver’s response that the wreck occurred when he swerved to miss an armadillo.

He also claimed that the deputy did not search the locked camper shell of his Chevy pick up , which must be where the beer cans were located.

New District Judge Bruce Anderson apparently didn’t believe the story, pointing out that the heavily traveled highway (138 towards Winchester) would have produced several calls to law-enforcement during that time it would have taken to achieve a .19 breath alcohol score.

Crouch was found guilty of DWI, and not guilty of failure to maintain control.

According to records, Crouch was a  back-up wide receiver for the Razorbacks in 2014.

UPDATE –  When this case was appealed to Circuit Court, it was dismissed by the prosecution , and Crouch was ruled “not guilty.”
