Former Circuit Clerk Ordered to Pay Restitution to County & State
July 2nd, 2013 by Joe BurgessThe restitution hearing for former Drew County Circuit Clerk Pat Savage Montgomery was held Monday morning, at the Drew County Courthouse.
Both the prosecution and the defense agreed on the amount of restitution to be paid the county,$10,811.63, which was paid after the hearing.
The dept of legislative audit asked for another $12,960, based on the number of state employee hours involved in the investigation. An auditor testified that the agency spent 162 hours on the case at $80/hour.
Montgomery’s attorney, Charles Sidney Gibson, claimed that the dept. of legislative audit was simply performing their routine tasks, and those costs were included in their state operatins budget.
The special appointed judge, Judge John Langston of Little Rock, ruled that the research time was specifically used on this case, and ordered it to be paid by Montgomery, as well.
In February, Montgomery pled guilty to falsifying business records and misuse of office. She was given a one year suspended imposition of sentence.
