Constable Candidate Withdraws from Election, But Voting Must Go On (State Law)

During the May 24 primary election, for the position of Marion Township constable, covering Monticello and approximately 1 mile outside of it, David Menotti Jr won the election, over Joshua Henley and Dann Garrison. But, since Menotti did not have 50% of the vote, he is in a runoff election, with early voting beginning today, against Henley.
But……… Two days after that election, the county clerks office was questioned about the actual location of Henley’s residence, based on tax records showing that he lived near Cominto.
County attorney Cliff Gibson advised county clerk Nancy White to contact county sheriff Mark Gober to conduct an investigation, to see if Henley was actually eligible to run for Marion county constable.
On May 31, Henley submitted written notification of his withdrawal from the race to the county clerk‘s office.
According to state law, the runoff election still must take place.
Menotti serves as the Monticello Police Department K-9 handler, along with his best friend Cezar. Henley is a deputy at the Lincoln County Sheriffs Department, based out of Star city.
