Update – Child Rape Jury Trial Ends in Mistrial
A 39 year old E. Jackson St. resident was in Drew County Circuit Court for his jury trial on the charge of raping a 9 year child.
Ricky Dale Halley is accused of “deviant sexual activity” against a 9 year old female victim, for events that took place around April 3 of last year.
The victim was staying at her friend’s house, that weekend, to attend a concert at a local festival.
The jury was selected Wednesday morning, and attorney statements began at 10:30.
Multiple prosecution witnesses are expected, including a physician from Arkansas Children’s Hospital.
The defense claims that there is “insufficient credible evidence” that the crime occurred, as it was described, and the case was filed, only after the victim’s mother wrecked the defendant’s truck.
The victim was called to the witness stand at 11 am.

Update-
During the afternoon witness testimony, specifically during cross-examination of the ACH physician, Judge Gibson declared the case a mistrial, based on issues over evidence.
The case will likely be retried in the near future.
