In August, MLive posted a report of a major victory in the City of Monticello’s battle against SIEMENS, where a United States District Judge ordered SIEMENS AG (an international conglomerate) to be listed as an extended defendant in the $10,000,000 case.

Tuesday’s hearing, in Little Rock, is an effort by Siemens to remove Siemens AG from the case.

Sources close to the city feel confident that the hearing, where they will be represented by a local attorney Cliff Gibson, will turn out in their favor.

The case began with a contract between siemens in the city of Monticello to install water meters and replace leaking water lines.  A different brand of water meters was installed;  many of them poorly.  Then Siemens left town, after many questions arose about the scope of their future work, before providing the CT with a map of where the new lines would be installed.   Now, everything is tied up in federal court litigation.

Attached is the relative wording from the judge’s earlier order.

“Siemens Industry’s motion, No. 15, is denied. Monticello has stated a claim for fraud. Monticello pleaded with particularicularity—the who, what, when, where, and how of its claim.—about whether Siemens Industry secured a contract with MonticeIIo to fix water lines and replace meters through misrepresentations about Siemens Industry’s financial backing by Siemens AG, itse indirect parent corporation.

The Court directs the Clerk to add Siemens AG as a counter-defendant in this case.
