Pedraza’s Attorney Files Writ with State Supreme Court

Last week in the Drew County Circuit Court, attorney Jeff Rosenzweig, representing Daniel Pedraza, was denied a continuance by Judge Bynum Gibson in Pedraza’s capital murder case, for the death of his 2 year old step-daughter Aubriana Coke.

Issues involved in the motion for the requested continuance include: Pedraza’s military service and a possible diagnosis of PTSD; the need to contact Pedraza’s family members in Mexico, about possible mitigating circumstances stemming from his childhood; and whether a member of Pedraza’s defense team (serving as an investigator for Pedraza in the case) could testify as a witness in an ex-parte hearing, due to attorney-client privilege.

Prosecuting attorney Thomas Deen responded the state has a right to be present at any such hearing, adding that the defense is using a team member attorney as their document research analyst, which is unfair.

Judge Gibson denied the motion for continuance, telling the courtroom, “an ex-parte hearing would put a judge in the role of an advocate for the defense and take away any impartiality that the judge would have.”

After the hearing attorneys Rosenzweig filed a notice of appeal and intention to seek a Writ of Certiorari with the Arkansas Supreme Court, asking it to review the decision by Judge Gibson to deny the continuance of the trial, based on sealed privilege documents and rulings in regard to lawyer-client privilege.

The jury trial date for Pedraza is set for the week of October 22.

    When you commit a crime you need to know your gonna do the time that goes with that crime

    Becky: you are right and WHEN he is convicted he will serve the time that goes with the crime. No time can be long or soon enough for either him or the woman that the precious child called Mommy.

    Karie: You have an honest point nope he has not been convicted HOWEVER, that conviction IS knocking on his door and his partner in crime’s door. THEN he and the innocents little girls Mother can both start serving that time they deserve for that crime.

    SICK is all I can think of to sum this up and these are my feelings not trying to bash anyone or put anyone down (even though I bet there are many others that feel the same way as I do) This little girl deserved to still be here enjoying swimming, going to the park, eating happy meals but NO these 2 are here and she is gone. She is better off than any of us because of where she is but so sad she had to go the way she did.

    Just put him in a cell with my ex. He always doles out punishment to those who harm children and women. This is a sad case. A poor innocent gone and the others involved are just enjoying the air we all have to share. I know the ones behind bars are responsible, but where was the grandparents? Aunts? Uncles? Cousins to protect her. They are all just as guilty. I really hope they both get a cell mate like my ex, one can only hope.
